1. Introduction and Platform Role

Welcome to TravelForFun (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our platform, which connects open-minded adults for accommodation sharing and social experiences worldwide.

Platform Role: We are a technology intermediary that provides a platform for users to connect. We are NOT an agent, broker, representative, landlord, or party to any agreements between users. Hosts are independent individuals, and no employment, partnership, or agency relationship exists between us and any user.

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Age Verification and Minor Protection

18+ ONLY - ZERO TOLERANCE FOR MINORS

You must be at least 18 years old to use our platform. By registering for an account, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• All information you provide is accurate and current
• You will maintain the accuracy of such information

Zero Tolerance Policy: We maintain a strict zero-tolerance policy regarding minors. Any user found to be under 18, or who uploads content involving minors, will be:

• Immediately and permanently banned
• Reported to law enforcement authorities
• Subject to legal action

You are prohibited from posting, sharing, or transmitting any content involving individuals under 18 years of age.

3. User Verification Disclaimer

CRITICAL NOTICE: We do NOT conduct any verification of users. You acknowledge and accept that we do not:

• Perform criminal background checks
• Verify identity, age, or any biographical information
• Conduct STI/STD or health screenings
• Verify relationship status or marital consent
• Confirm sexual orientation or lifestyle claims
• Screen for history of violence or sexual misconduct
• Verify financial status or housing ownership
• Validate photographs or profile authenticity

Users may misrepresent themselves. You are solely responsible for evaluating and verifying the identity and suitability of anyone you interact with.

4. Platform Purpose and Adult Content Policy

Platform Purpose: TravelForFun is a social connection and accommodation-sharing platform for open-minded adults. We provide a platform for adults to meet and arrange accommodation. We do NOT arrange, supervise, participate in, or facilitate any offline interactions between users.

No Commercial Sexual Services:

• This platform is NOT an escort service
• We do NOT broker, facilitate, or permit commercial sexual services
• Any exchange of money or goods for sexual services is strictly prohibited
• We do NOT compensate users for sexual activity
• Users may NOT offer or solicit prostitution

Consensual Adult Activity: Any intimate or sexual activity between users is:

• Entirely incidental to accommodation sharing
• Solely the decision of consenting adults
• NOT arranged, expected, or facilitated by our platform
• Subject to mutual consent and compliance with all applicable laws
• Entirely at users' own risk and responsibility

User Responsibility: You are solely responsible for all decisions regarding intimate or sexual activity. You must obtain explicit, enthusiastic consent for any physical contact. Violation of consent is a crime and will result in account termination and reporting to authorities.

5. Account Registration and Security

To access certain features of our platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account
• Use only your own photographs and information

6. Content Moderation and Explicit Content Rules

Allowed Content: You may post:

• Profile photos showing your face
• Non-explicit photos in swimwear or casual nudity
• Artistic or tasteful partial nudity
• Accommodation and travel photos

Prohibited Content: You may NOT post:

• Hardcore pornography or graphic sexual acts
• Genitalia or explicit close-up sexual imagery
• Content involving minors in any context
• Non-consensual or revenge pornography
• Content depicting violence, rape, or abuse
• Content violating others' intellectual property rights
• False, misleading, or fraudulent content

Platform Rights: We reserve the right to:

• Remove any content at our sole discretion without notice
• Suspend or ban users for content violations
• Shadow-ban users or limit visibility
• Remove content that violates our brand image
• Moderate all user-generated content

7. Photo and Media Consent

By uploading photos or media to our platform, you warrant that:

• You own all rights to the content or have explicit permission to use it
• All individuals depicted have consented to the use and publication
• No content is revenge porn or non-consensual imagery
• You grant us a worldwide, non-exclusive, royalty-free license to display your content
• You will not post private images of others without authorization

Violation of these terms, including posting non-consensual imagery, will result in immediate termination and potential legal action.

8. Health and STI Disclaimer

CRITICAL HEALTH NOTICE:

• We do NOT require, verify, or guarantee health status of any user
• We do NOT require STI/STD testing or vaccination status
• We do NOT screen for contagious diseases or health conditions
• Users are solely responsible for protecting their own health
• You must take appropriate precautions for safe sex and disease prevention
• We assume NO liability for health outcomes, including STI transmission

You acknowledge that intimate contact with other users carries inherent health risks, including but not limited to sexually transmitted infections. You assume all such risks entirely.

9. Assumption of Risk

BY USING THIS PLATFORM, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH:

• Physical Safety: Assault, battery, physical injury, violence, kidnapping, or death
• Sexual Safety: Sexual assault, rape, coercion, or violation of consent
• Health Risks: STIs, STDs, communicable diseases, allergic reactions, or other health conditions
• Emotional Harm: Emotional distress, psychological trauma, harassment, or manipulation
• Property Loss: Theft, damage, or loss of personal property
• Financial Loss: Fraud, scams, identity theft, or unauthorized charges
• Privacy Violations: Unauthorized recording, photography, or disclosure of private information
• Legal Consequences: Including but not limited to arrest or prosecution for activities with other users

You acknowledge that meeting strangers in private settings carries significant inherent risks and you willingly assume all such risks.

10. Prohibited Activities

You may not use our platform to:

• Violate any local, state, national, or international law
• Engage in, promote, or facilitate prostitution, sex trafficking, or commercial sexual services
• Harass, stalk, abuse, threaten, or harm another person
• Violate consent or engage in non-consensual activity of any kind
• Impersonate any person or entity
• Post false, misleading, or fraudulent content
• Upload content involving minors in any context
• Share non-consensual intimate images (revenge porn)
• Transmit viruses, malware, or other malicious code
• Collect or store personal data about other users without consent
• Interfere with or disrupt the platform's functionality
• Use automated systems to scrape or harvest data
• Discriminate based on race, ethnicity, religion, disability, or other protected characteristics

11. User Reporting and Safety Mechanism

Reporting System: You may report users who violate these Terms, engage in illegal activity, or make you feel unsafe.

How We Handle Reports:

• We review all reports but do not guarantee action
• We may investigate by reviewing messages, profiles, and user activity
• We reserve the right to suspend accounts during investigation
• We may ban users without warning or explanation
• We cooperate with law enforcement when legally required
• We do NOT mediate disputes between users
• We do NOT conduct independent investigations of offline incidents

Emergency Situations: If you are in immediate danger, contact local police or emergency services immediately. We cannot provide real-time emergency assistance.

Law Enforcement Cooperation: We will cooperate with valid legal requests and may disclose user information pursuant to lawful subpoenas, court orders, or investigations.

12. Accommodation and Host Liability

Direct Agreements: When you book accommodation through our platform:

• You enter into a direct agreement with the host
• We are NOT a party to the accommodation agreement
• We are NOT a landlord, property manager, or broker
• Cancellation policies are set by individual hosts
• You must respect the host's house rules and cancellation terms

No Landlord Liability:

• No landlord-tenant relationship is created
• No tenancy rights are granted
• No short-term rental guarantees are provided
• Hosts are solely responsible for compliance with local housing and short-term rental laws
• We are not liable for property conditions, safety, or habitability

13. Payments, Fees, and Chargebacks

Our platform may charge service fees for facilitating connections and bookings. All fees will be clearly displayed before you complete a transaction.

Payment Terms:

• Service fees are non-refundable unless otherwise stated
• Digital services are non-refundable once delivered
• You are responsible for all applicable taxes
• Payment processing is handled through secure third-party providers
• Refund policies for accommodation are subject to the host's terms

Chargeback and Fraud Protection:

• Fraudulent chargebacks will result in immediate account termination
• We reserve the right to suspend accounts with disputed transactions
• We may pursue legal action for fraudulent chargebacks
• We monitor for fraud and may freeze accounts pending investigation
• Costs associated with chargeback disputes may be charged to your account

14. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our platform, you consent to our data practices as described in the Privacy Policy.

International Compliance: We comply with applicable data protection laws, including GDPR for EU users and other regional requirements. Users outside our primary jurisdiction may have additional rights under local law.

15. Intellectual Property and Content Rights

Your Content: You retain ownership of content you post on our platform. By posting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content in connection with operating the platform.

Our Content: All platform content, features, functionality, design, and branding are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform without written permission.

16. Electronic Communications Consent

By using our platform, you consent to:

• Receive electronic communications from us, including emails, notifications, and messages
• Receive all agreements, notices, and disclosures electronically
• Electronic signatures being legally binding
• Marketing and promotional communications (you may opt out at any time)

17. Account Termination

We reserve the right to suspend or terminate your account immediately, without notice, at our sole discretion, for:

• Violations of these Terms
• Fraudulent, illegal, or harmful activity
• Behavior that harms other users or the platform
• Multiple user complaints or reports
• Extended periods of inactivity
• Content that violates our policies or brand standards
• Chargebacks or payment disputes
• Any reason or no reason at all

You may terminate your account at any time through your account settings. Termination does not relieve you of any obligations incurred prior to termination.

18. Disclaimers and Limitations of Liability

SERVICE PROVIDED “AS IS”:

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT:

• The accuracy, reliability, or completeness of user profiles or content
• The identity, background, intentions, or safety of any user
• The quality, safety, or legality of accommodations listed
• The conduct or character of any user
• Whether users will fulfill their obligations
• The availability, security, or uninterrupted operation of the platform

LIMITATION OF LIABILITY:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRAVELFORFUN, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• ANY DAMAGES FOR PERSONAL INJURY, EMOTIONAL DISTRESS, SEXUAL ASSAULT, OR DEATH
• ANY DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL
• ANY DAMAGES ARISING FROM INTERACTIONS WITH OTHER USERS
• ANY DAMAGES FROM SEXUALLY TRANSMITTED INFECTIONS OR OTHER HEALTH CONDITIONS
• ANY THEFT, FRAUD, OR PROPERTY DAMAGE
• ANY CONTENT POSTED BY USERS
• ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS LESS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

19. Indemnification

You agree to indemnify, defend, and hold harmless TravelForFun, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another user or third party
• Your content posted on the platform
• Your offline interactions with other users
• Any claims arising from intimate or sexual activity with other users
• Any claims arising from accommodation arrangements
• Your violation of any applicable laws or regulations
• Any negligence or willful misconduct by you

This indemnification obligation will survive termination of your account and these Terms.

20. Dispute Resolution and Arbitration

Binding Arbitration: Any disputes, claims, or controversies arising from these Terms or your use of the platform shall be resolved through binding arbitration, except where prohibited by law.

Class Action Waiver: YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION. All disputes must be resolved on an individual basis.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or unauthorized access to the platform.

21. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

For international users: Local laws may provide you with additional rights not waivable by these Terms. Nothing in these Terms limits your statutory rights under applicable consumer protection laws.

22. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, earthquakes, floods, or severe weather
• War, terrorism, civil unrest, or acts of government
• Pandemics, epidemics, or public health emergencies
• Internet outages, cyberattacks, or infrastructure failures
• Labor strikes, lockouts, or supplier failures
• Changes in law or government regulations

23. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through prominent notice on the platform at least 30 days before the changes take effect.

Your continued use of the platform after changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of the platform.

25. Severability

These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and TravelForFun regarding the use of our platform, superseding any prior agreements.

Lifestyle Terminology Disclaimer: Any lifestyle labels, preferences, or descriptors used on the platform are self-reported and not verified. We make no guarantees about compatibility, authenticity, or accuracy of lifestyle claims.

Reputation System Disclaimer: Reviews and ratings are user opinions only. We do not endorse, guarantee, or verify the accuracy of user reviews. Past positive reviews do not guarantee future safe experiences.

Alcohol and Substance Disclaimer: You are solely responsible for your decisions regarding alcohol or substance use. We are not liable for impairment, poor judgment, accidents, or injuries related to substance use.
